Kuku Terms of Service

1. Introduction & Acceptance
These Terms of Service (“Terms”) form a legally binding agreement between: You (“User,” “you,” or “your”) and Futuro AI, Inc. (“Company,” “we,” “us,” or “our”), a Delaware corporation. These Terms govern your access to and use of:
the Kuku mobile application
our website
all related content, features, tools, and services
(collectively, the “Services”).
Important
By downloading, registering for, accessing, or using the Services, you:
✔ confirm you have read and understood these Terms
✔ agree to be bound by them
If you do not agree, do not use the Services.
Dispute Resolution Notice
These Terms include:
mandatory arbitration
a class action waiver (see Section 15)
Except for certain small claims matters, all disputes must be resolved individually through binding arbitration.
2. Eligibility & Accounts
2.1 Age Requirements
The Services are not intended for children under 13
You must be at least 13 years old to use the Services
If you are under 18, a parent or legal guardian must consent
By using the Services, you confirm that you meet these requirements.
2.2 Account Registration
Some features require an account, including:
Co-Parenting
Sleep Companion Mode
You agree to:
provide accurate and complete information
keep your information updated
protect your login credentials
2.3 Account Responsibility
You are responsible for everything that happens under your account.
Notify us immediately at teams@futuro.live if you suspect unauthorized use.
We may suspend or terminate accounts with inaccurate or misleading information.
3. Core Features
3.1 Co-Parenting & Data Sharing
When you link with a Partner or Bestie, you explicitly consent to sharing activity data, including:
online status
sleep patterns
Kuku interactions
quiz responses and AI insights
You are solely responsible for choosing who you link with.
We are not responsible for disputes or privacy issues between users.
3.2 Unlinking
You may unlink at any time in App settings.
Unlinking may permanently delete shared progress, memories, or assets.
We are not liable for any resulting loss.
3.3 Sleep Companion Mode Disclaimer
Sleep tracking uses device sensors such as microphones and motion detection.
This is not a medical service or device.
All sleep data is provided for:
entertainment
• general information
It does not diagnose or treat health conditions.
Always consult a qualified medical professional for health concerns.
3.4 AI Features
The Services use AI to generate dialogue, insights, and advice.
You understand that:
AI may be inaccurate or inappropriate
outputs are not professional advice
you should not rely on them for major life or mental health decisions
4. Virtual Currency & Items
4.1 License
Virtual items (including “Moonstones”) are licensed — not sold.
You receive a limited, personal, non-transferable right to use them only within the App.
4.2 No Real-World Value
Virtual Goods:
have no cash value
cannot be redeemed or transferred
are not property
4.3 Randomized Rewards
Some features use chance-based mechanics (Blind Boxes).
Item probability rates are disclosed in the App.
Outcomes are random and not guaranteed.
4.4 Changes & Expiration
We may modify or remove Virtual Goods at any time without liability.
5. Subscriptions & Payments
5.1 Kuku Plus
Subscriptions may include:
bonus Moonstones
premium features
exclusive items
Some plans allow linked Partner access while the main subscription is active.
5.2 Billing & Auto-Renewal
When you subscribe:
charges occur through Apple or Google Play
subscriptions renew automatically
cancel at least 24 hours before renewal
5.3 Cancellation
Cancel through your App Store settings.
Deleting the App does not cancel billing.
Access continues until the current billing period ends.
5.4 Free Trials
Trials automatically convert to paid subscriptions unless canceled 24 hours before ending.
5.5 Refunds
All purchases are final and non-refundable.
Refunds are governed by Apple and Google Play policies.
5.6 Price Changes
We may adjust pricing with notice, effective on your next billing cycle.
6. User Content
6.1 Ownership & License
You own your content.
By submitting it, you grant us a worldwide, royalty-free license to use it to:
operate the Services
improve features
train AI (using de-identified data)
6.2 Prohibited Content
You may not submit content that is:
illegal or abusive
hateful or violent
spam or malicious
harmful software
7. Prohibited Conduct
You may not:
use the Services unlawfully
harass other users
scrape or automate access
reverse engineer the App
exploit bugs
sell accounts or virtual items
8. Service Changes
We may modify, suspend, or discontinue any part of the Services at any time.
Availability is not guaranteed.
9. Third-Party Services
We are not responsible for third-party sites or services linked in the App.
Use them at your own risk.
10. Intellectual Property
All content, characters, software, and design belong to Futuro AI, Inc. and its licensors.
They are protected by intellectual property laws.
11. No Warranties
The Services are provided “as is” and “as available.”
We disclaim all warranties, including:
merchantability
fitness for a particular purpose
uninterrupted or error-free operation
12. Limitation of Liability
We are not liable for:
indirect or consequential damages
lost data or profits
third-party conduct
Our maximum liability is the greater of:
amounts you paid in the past 12 months
• $100 USD
13. Indemnification
You agree to defend and hold us harmless from claims arising from:
your use of the Services
your content
your violation of these Terms
14. Apple Terms
If used on iOS:
Apple is not responsible for the App
Apple provides no support or warranties
Apple may enforce these Terms as a third-party beneficiary
15. Arbitration & Class Waiver
Binding Arbitration
All disputes are resolved by AAA arbitration, except small claims court.
No Class Actions
Claims must be brought individually.
Opt-Out
Email teams@futuro.live within 30 days of first use to opt out.
16. Governing Law
Delaware law applies.
17. Changes to Terms
We may update these Terms with notice.
Continued use means acceptance.
